Estate Planning

With the current exemption amounts, only 1.2% estates will be subject to estate tax.  But there is so much more to estate planning than reducing or eliminating estate tax liability. 

Planning for minor children, children with special needs and working with blended families resulting from subsequent marriages are much more prevalent reasons to have a well thought out estate plan in place.  Properly drafted estate documents allow you to determine to whom, in what amount, and when your assets will be distributed to those you want to benefit from your life’s hard work and accumulation of assets.

Trust Administration

Creating and funding a trust is sometimes the easiest part.  Afterwards, the Trustee has to administer the Trust and the questions just keep coming.  If you are a Trustee, you have certain legal obligations (fiduciary duties) that you need to perform.  Having legal guidance/oversight will give you peace of mind and help to ensure you understand and follow the terms of the Trust you are now legally obligated to manage.

Elder Law

The National Academy of Elder Law Attorneys (NAELA) sates that elder law includes helping individuals with planning for incapacity and long-term care, health and long term care insurance and health care decision making.

Currently there are about 6 million people in the US living with dementia.  It is estimated that 1 out of every 6 females and 1 out of every 10 males living past the age of 55 will develop dementia.

With proper planning, some of the burden related to incapacity can be taken off your loved ones.  The amount of misinformation floating around can either prevent people from doing anything or cause them to do the wrong thing.  Discussing these issues and the options available to you with an experienced attorney in this area is crucial to developing a plan that will work.
